PLEASE READ THESE TERMS OF SERVICE (“TERMS”) CAREFULLY BEFORE USING ANY FLAMINGO APPAREL INC. PLATFORM.
BY ACCESSING OR USING ANY FLAMINGO APPAREL INC. WEBSITE, MOBILE APPLICATION, OR OTHER DIGITAL SERVICE (COLLECTIVELY REFERRED TO AS THE “PLATFORM”), YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE PLATFORM.

User Content
License to FLAMINGO APPAREL INC.

Limitation of Liability
To the fullest extent permitted by law, FLAMINGO APPAREL INC. is not liable for:
Any indirect, incidental, or consequential damages.
Any loss of data or profits arising from your use of the Platform.
If FLAMINGO APPAREL INC. is found liable for any claim, our liability is limited to $100 or the amount you paid for the service in question, whichever is less.

Your violation of these Terms, or
Your violation of any third-party rights.

Termination
FLAMINGO APPAREL INC. reserves the right to suspend or terminate your account or access to the Platform at any time, for any reason, without notice. Upon termination, your rights to use the Platform cease immediately.

Governing Law and Dispute Resolution
Governing Law
These Terms are governed by Florida state laws, without regard to its conflict of laws principles.
Dispute Resolution
Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration, except where prohibited by law. Arbitration will be conducted in Fort Lauderdale Florida.

Miscellaneous
Entire Agreement
These Terms, along with the Privacy Policy and any additional terms, constitute the entire agreement between you and FLAMINGO APPAREL INC. regarding your use of the Platform.

Sever-ability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
